OT: No reason to remove a child

Okay, so this is off topic, but its my blog so I decide what to include.

If a grade school child may or may not have hurt his younger brother or sister but there is no permanent damage and there is no evidence that the child actually did hurt his sibling, should a social worker be able to remove the older child from its parent's home without a hearing? I don't think so.

Here is the full story. The napoleonic code is alive and well in the land of social services. Certainly the constitution of the United States has no standing when a child can be seized under these circumstances without even a bail hearing or an arraignment.
